This website is operated by M&M BBQ Company, LLC. Throughout these Terms, the terms “we,” “us,” and “our” refer to M&M BBQ Company. By visiting our site or purchasing from us, you agree to be legally bound by these Terms and any additional policies or documents referenced herein.

Online Store Use

You must be at least the age of majority in your jurisdiction, or have the permission of a parent or legal guardian, to use this site. You agree not to use our products or services for any unlawful purpose or to violate any applicable laws. Transmission of any malicious code or viruses is strictly prohibited. Any breach of these Terms may result in immediate termination of your access to our services.

General Conditions

We reserve the right to refuse service to anyone for any reason at any time. Your content (excluding credit card information) may be transferred unencrypted and may involve transmissions over various networks. Credit card information is always encrypted during transfer. You agree not to duplicate, reproduce, sell, or exploit any portion of the service or content without express written permission.

Website Accuracy

While we strive to maintain accurate and up-to-date information on our site, we are not responsible for any inaccuracies, omissions, or outdated content. The material is provided for general information only and should not be relied upon as the sole basis for making decisions. We reserve the right to modify content without notice.

Pricing and Services

Prices for our products and services are subject to change without notice. We reserve the right to modify or discontinue any product or service at any time. We may limit or cancel quantities available or ordered, especially in cases of suspected reselling or misuse.

Refund, Return, and Cancellation Policy

M&M BBQ Company manufactures custom-fabricated products built specifically to each customer’s order. Engineering, production scheduling, material procurement, and administrative work begin immediately upon receipt of your deposit. As a result, all orders are subject to the following cancellation policy.

Customers may cancel their order within 10 calendar days of the date their deposit is received and receive a refund of their deposit, less a cancellation fee equal to 10% of the total work order amount.

If an order is canceled within this 10-calendar-day period, 10% of the total work order amount will be retained as a cancellation fee. The remaining portion of any deposit paid will be refunded.

Example:

Total Order Amount: $10,000.00
Deposit Paid: $5,000.00 (50%)
Deposit Received: 1st day of the month
Cancellation Deadline: End of the 10th calendar day
Cancellation Fee: 10% of the total order = $1,000.00
Deposit Refund: $4,000.00

The 10-day cancellation period begins on the date your deposit is received, not the date the order is quoted or invoiced. Written notice of cancellation must be received no later than the end of the 10th calendar day following receipt of your deposit and must be submitted by the purchaser.

After the 10-calendar-day cancellation period has expired, the order is no longer eligible for a refund. At M&M BBQ Company’s sole discretion, the order may be canceled only upon the purchaser’s written request and forfeiture of the entire deposit. Such requests must be submitted in writing and signed by the purchaser acknowledging that they understand and accept the forfeiture of the full deposit.

By submitting a deposit, the purchaser acknowledges that they have read, understood, and agree to this Cancellation Policy.

Products and Descriptions

Certain products may only be available online and may have limited quantities. We have made every effort to display products as accurately as possible; however, we do not guarantee that your monitor’s display of colors will be accurate. We reserve the right to discontinue any product at any time or limit sales based on jurisdictional restrictions.

Billing and Account Information

You agree to provide current, complete, and accurate billing and contact information for all purchases. We reserve the right to cancel or limit orders if we suspect fraud or unauthorized reselling. In such cases, we will attempt to notify you using the information provided at the time of order. Please review our Refund and Return Policy for further details.

Limited Warranty

Limited Warranty For M&M BBQ Company – New Equipment

M&M BBQ Company warrants that all product manufactured by us will be free from defects in materials and workmanship under normal use for which the product was designed, and for a period of (14) months from the date of completion. Labor charges are not covered as part of the limited warranty after (120) days from purchase.

This warranty applies only to the original purchaser and is non-transferable. Our obligation under this warranty is limited to repairing or replacing, at our option, any part or parts which prove defective within the warranty period, and which upon examination shall satisfy us that they are defective and have not been misused. Repairs conducted by a third party void the entire warranty if the repairs are not approved by an M&M BBQ Company representative.

Warranty Limitations & Exclusions

This warranty does not cover damage or defect caused by:

Normal wear and tear, accidents, abuse, misuse, abnormal use, tampering, alteration, improper maintenance or improper installation by any party other than M&M BBQ Company.
Damage from exposure to outside elements where proper storage is abandoned.
Modifications, disassembly, or repairs made without authorization from M&M BBQ Company or its authorized representatives.
Natural disasters, fire, or other casualties.
Incidental or consequential damages of any kind.

The warranty will be void if you continue using the unit after giving us notice of the defect; if the defect results from the unit not being stored, installed, used or maintained per our instructions; or if the unit is altered or repaired without our prior written consent.

This warranty does not cover paint loss, discoloration, fading, rust, or oxidization. Surface coatings are purchased at your own risk. While we make every effort to ensure the best application of paint is used, fire and smoke will always win over paint.

This warranty is provided solely to repair or replace defective components or products. M&M BBQ Company reserves the right to inspect any defective part to determine if the defect is covered by this warranty.

Limitation on Damages

M&M BBQ Company’s liability is limited solely to repair or replacement of the defective product itself. M&M shall not be liable for any incidental or consequential damages of any kind arising from the purchase, installation, use or inability to use the product, including but not limited to loss of profits, loss of use, damage to other equipment, or personal injury of any kind unless caused by M&M’s gross negligence. In no event shall M&M BBQ Company’s maximum liability exceed the purchase price paid for the product.

This warranty is the sole and exclusive warranty for M&M BBQ Company products. No employee, agent, dealer or other person is authorized to alter this warranty or make any other warranty on behalf of M&M. M&M BBQ Company disclaims any liability for any oral or written statements about the product made by a dealer, service company or other third party.

Warranty Disclaimer: This limited warranty replaces all other warranties, whether written, spoken, express, or implied. This includes any implied warranties of merchantability or fitness for a particular purpose. The warranty described herein applies to Products sold within the U.S.A. only. Warranty Claim Process

To obtain warranty service, purchaser must:

Request warranty work in writing within the warranty coverage time.
Immediately stop use of the Product or warranty is voided.
Follow any pre-service requirements for warranty work or work will not be performed under warranty policy.

Third-Party Tools

We may provide access to third-party tools over which we have no control or input. You acknowledge and agree that these tools are provided “as is” and “as available,” without any warranties or representations. Use of these tools is at your own risk.

Third-Party Links

Certain content or services may link to third-party websites. We are not responsible for examining or evaluating their content or accuracy and do not warrant or accept any liability for third-party materials or websites. Please review their terms and policies before engaging in any transactions.

User Submissions

If you send us comments, suggestions, ideas, or other materials (collectively “submissions”), you grant us a non-exclusive, royalty-free, perpetual, and irrevocable right to use, modify, publish, and distribute those submissions in any medium. We are under no obligation to maintain submissions in confidence or respond to them.

Errors and Corrections

We reserve the right to correct any errors, inaccuracies, or omissions on the site, including pricing and availability, at any time and without prior notice, even after an order has been placed.

Prohibited Uses

You may not use the site or its content for any unlawful or prohibited purpose, including but not limited to: violating laws, infringing on intellectual property rights, harassing or discriminating against others, submitting false information, transmitting malicious code, collecting personal data of others, spamming, or interfering with security features. Violations may result in termination of your access.

You agree to indemnify and hold harmless M&M BBQ Company and its affiliates, officers, employees, and agents from any claims or demands arising out of your breach of these Terms or violation of any law or third-party rights.

Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision shall be severed from the agreement, and the remaining terms shall remain in full force and effect.

Termination

These Terms remain in effect until terminated by either party. You may terminate by ceasing use of the site. We may terminate or suspend access if you violate these Terms. Upon termination, your obligations and liabilities incurred prior to the date of termination shall survive.

Entire Agreement

These Terms and any policies posted on this site constitute the entire agreement between you and M&M BBQ Company. Our failure to enforce any part of these Terms shall not be deemed a waiver of that right.

Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Texas. Any dispute shall be resolved through confidential arbitration in Dallas County, Texas, under the rules of the American Arbitration Association. By agreeing, you waive your right to bring a lawsuit in court, except for matters related to intellectual property. Any claim must be brought within one (1) year from the event giving rise to it.

Modifications to Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page, and continued use of the site after changes are posted constitutes acceptance of those changes.

Disclaimer of Warranties and Limitation of Liability

We do not guarantee uninterrupted, timely, or error-free service. All products and services are provided “as is” and “as available” without warranties of any kind. We are not liable for any damages, losses, or claims arising from your use of the site or products. In jurisdictions that do not allow limitations on implied warranties or liability, our liability shall be limited to the maximum extent permitted by law.

Intellectual Property

All designs, logos, names, and content on the site are the property of M&M BBQ Company. You may not reproduce, resell, or exploit any content without our written consent. Infringements should be reported promptly.

Payments and Shipping

Equipment built to order requires a 30% deposit to be scheduled for production. The remaining balance is due no less than thirty (30) days before shipment. Website purchases of in-stock items and accessories require payment in full. Delays in payment will result in a delay to production and shipment. If shipping is required, freight is billed separately and is due with the final payment.

Risk of Loss and Transfer of Title

Risk of loss transfers to the customer upon delivery. Title does not pass to the customer until full payment is received. Until then, M&M BBQ Company retains a security interest in the products.
